Account and Eligibility

Some features require creating an account. Users are responsible for managing their authentication credentials and for any disclosure or unauthorized use that results from failing to protect them.

Users under 13 years old or lacking legal capacity may not be able to use the service.

Service Description

The service provides a productivity and eye-care timer with optional cloud features such as syncing and analytics. We may modify, suspend or discontinue the service (or some features) at any time with or without notice.

This service is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease. The eye care features are designed to support productivity and comfort during screen work but do not provide medical benefits or guarantees. If you have health concerns, please consult a healthcare professional.

Subscription and Fees

Subscriptions include free and paid plans; paid plans provide additional features.

Subscription fees are billed in advance for the selected billing period and automatically renew unless cancelled before the renewal date.

Payments are processed by a Stripe. We do not store full payment card details on our servers. Cancellation stops future renewals; refunds are provided only as described in the refund policy or as required by law.

Service License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the service for your personal or internal business purposes.

You shall not (a) copy, modify, or create derivative works of the service source code or machine learning models; (b) resell the service; or (c) use the service to develop a competing product.

User Conduct

You agree not to misuse the service, attempt to gain unauthorized access, interfere with the service or transmit illegal content. You are responsible for compliance with applicable laws in connection with your use of the service.

Content and Intellectual Property

All content provided by the service, including text, graphics, and software, is owned by or licensed to the service provider and is protected by intellectual property laws. You may not reproduce or redistribute content without permission.

Limited Warranty & Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROVIDER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.

IN NO EVENT WILL THE PROVIDER BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

Force Majeure

Neither party will be liable for delays or failures in performance resulting from causes beyond reasonable control, including natural disasters, acts of war, terrorism, epidemics, governmental actions, or failures of telecommunications or internet providers. The affected party will notify the other and seek to resume performance as soon as practicable.

Termination

We may suspend or terminate your access for violations of these Terms or for any other reason. Upon termination, your right to use the service ceases.

Limitation of Liability

To the maximum extent permitted by law, the provider's total aggregate liability arising out of or related to these Terms or the service will not exceed the total amount paid by you to the provider in the 12 months preceding the event giving rise to liability.

Indemnification

You agree to indemnify, defend and hold harmless the provider and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the service, your violation of these Terms, or your user content.

Changes to Terms

We may revise these Terms at any time. Continued use of the service after changes constitutes acceptance of the updated Terms.

Miscellaneous

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect. A failure to exercise a right is not a waiver of that right. These Terms constitute the entire agreement between you and the provider regarding the service.
